Facts– Tofan Singh, the appellant was arrested with three other people for the attempt to export 5 kilograms heroine to Sri Lanka. He made a confession before an Intelligence Officer of Narcotics Control Bureau. After convicted by the court, he then appealed to the Madras High Court, in which his appeal was dismissed. He then appealed to the Supreme Court.
Judgment– The Supreme Court held that the confession made before such type of officers would be barred under Section- 25 of the Indian Evidence Act, 1872 and cannot considered while convicting an accused under NDPS Act.
